1. Acceptance of Terms

By accessing and using TheBoothSpace (“the Platform”, “we”, “us”, or “our”), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Service Description

TheBoothSpace is an online marketplace platform that connects licensed barbers with barbershop owners who have available chair space for rent. We provide:

  • A platform for shop owners to list available barbershop chairs for rent
  • A search and booking system for barbers to find and rent chair space
  • Payment processing services through Stripe
  • Communication tools between barbers and shop owners

TheBoothSpace acts solely as a marketplace platform. We are not a party to any rental agreements between barbers and shop owners.

3. User Accounts and Registration

3.1 Account Creation

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

3.2 User Types

Our platform supports two user types:

  • Barbers: Licensed professionals seeking to rent barbershop chair space
  • Shop Owners: Barbershop owners offering chair space for rent

4. Licensing and Verification

4.1 Critical Notice: License Verification

Shop owners are solely responsible for verifying that all barbers have valid, current licenses before permitting them to work in their establishment.

TheBoothSpace does not verify, validate, or guarantee the licensing status or credentials of any barber. Shop owners must independently verify all licenses and comply with all local, state, and federal licensing requirements.

4.2 Barber Requirements

Barbers must:

  • Hold a valid barbering license in the jurisdiction where services are provided
  • Maintain current liability insurance as required by law
  • Comply with all health and safety regulations
  • Provide proof of licensing upon request by shop owners

4.3 Shop Owner Requirements

Shop owners must:

  • Verify all barber licenses before allowing any barber to work on their premises
  • Maintain all required business licenses and permits
  • Ensure their premises comply with all health and safety regulations
  • Maintain appropriate insurance coverage

5. Rental Agreements and Bookings

5.1 Booking Process

Barbers can search for and book available chair space through our platform. All bookings are subject to acceptance by the shop owner.

5.2 Rental Terms

The specific terms of each rental (including price, duration, hours of operation, and amenities) are determined by the shop owner and displayed in the listing. Both parties must agree to these terms before confirming a booking.

5.3 Direct Agreement

The rental agreement is directly between the barber and shop owner. TheBoothSpace is not a party to this agreement and assumes no responsibility for disputes arising from it.

6. Payments and Fees

6.1 Payment Processing

All payments are processed securely through Stripe. By using our payment services, you agree to Stripe's terms and conditions.

6.2 Platform Fees

TheBoothSpace charges a service fee on each transaction. The current fee structure is:

  • Barbers: [Percentage]% service fee on each booking
  • Shop Owners: [Percentage]% service fee on each rental received

These fees are clearly displayed before completing any transaction and are subject to change with 30 days notice.

6.3 Payment Schedule

Payment for chair rentals is due at the time of booking. Shop owners receive their payment after the rental period is completed, minus platform fees and any applicable refunds.

6.4 Taxes

Users are responsible for determining and paying any applicable taxes. TheBoothSpace does not provide tax advice and recommends consulting with a tax professional.

7. Cancellations and Refunds

7.1 Cancellation Policy

Each shop owner sets their own cancellation policy, which is clearly displayed in their listing. Common policies include:

  • Flexible: Full refund if cancelled 24+ hours before booking
  • Moderate: 50% refund if cancelled 48+ hours before booking
  • Strict: No refund unless cancelled 7+ days before booking

7.2 Extenuating Circumstances

Refunds may be considered for extenuating circumstances including serious illness, emergency, or circumstances beyond the user's control. All such requests are reviewed on a case-by-case basis.

8. Liability and Disclaimers

8.1 Platform Disclaimer

TheBoothSpace provides the platform “AS IS” without warranties of any kind. We do not:

  • Verify the identity, credentials, or licenses of users
  • Guarantee the quality, safety, or legality of any services or spaces listed
  • Assume responsibility for the conduct of any user
  • Guarantee the availability or condition of any listed space

8.2 Limitation of Liability

To the maximum extent permitted by law, TheBoothSpace shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from disputes between users
  • Damages resulting from unauthorized access to your account

8.3 User Insurance

Users are strongly encouraged to maintain appropriate insurance coverage including professional liability and general liability insurance.

8.4 Indemnification

You agree to indemnify and hold harmless TheBoothSpace, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform or violation of these terms.

9. Prohibited Uses

You may not use TheBoothSpace to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Engage in fraudulent or deceptive practices
  • Harass, abuse, or harm other users
  • Post false, misleading, or discriminatory content
  • Attempt to gain unauthorized access to the platform
  • Interfere with the proper functioning of the platform
  • Circumvent payment of fees
  • Use the platform for any illegal purpose

10. Intellectual Property

10.1 Platform Content

All content on TheBoothSpace, including text, graphics, logos, and software, is the property of TheBoothSpace or its licensors and is protected by copyright and trademark laws.

10.2 User Content

You retain ownership of content you post to the platform (such as photos and descriptions). However, you grant TheBoothSpace a worldwide, non-exclusive, royalty-free license to use, display, and distribute this content in connection with operating the platform.

11. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using TheBoothSpace, you consent to our collection and use of data as described in the Privacy Policy.

12. Dispute Resolution

12.1 Between Users

Disputes between barbers and shop owners should be resolved directly between the parties. TheBoothSpace may, at its discretion, provide assistance in facilitating communication but is not obligated to mediate disputes.

12.2 With TheBoothSpace

Any disputes with TheBoothSpace should first be addressed by contacting our support team at support@theboothspace.com. If the dispute cannot be resolved informally, it shall be governed by the laws of [Your State/Jurisdiction] and resolved through binding arbitration.

13. Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms and Conditions
  • Fraudulent or illegal activity
  • Complaints from other users
  • Non-payment of fees
  • Any reason at our sole discretion

You may cancel your account at any time by contacting support. Upon termination, you remain responsible for all outstanding fees and obligations.

14. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the platform. Your continued use of TheBoothSpace after changes are posted constitutes acceptance of the modified terms. We will notify users of significant changes via email or platform notification.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
